Carbon Capture, Utilization, and Storage (CCUS)

Latham leads the market in advising on CCUS projects and transactions, helping project sponsors, industry associations, and private equity firms develop and finance CCUS projects and generate environmental credits from the sequestered carbon. We work with clients and other advisors to develop the overall transaction structure and all other facets of the transaction. We guide clients through the CCUS permitting process, advise on regulatory requirements and environmental credit programs, negotiate and draft offtake and commodity hedging, EPC, and other project contracts.

Our premier project finance lawyers routinely advise on many of the largest financings in the world, including landmark CCUS and renewable energy projects. In the US, our integrated tax equity team develops 45Q tax equity and debt structures across a wide variety of carbon capture technologies, including those involving EOR, sequestration only, direct air capture, and centralized carbon capture across multiple emission sources.

Since these programs’ inceptions we have represented deficit generators, credit generators, intermediaries, marketers, and capital providers for all types of low carbon fuels, including renewable diesel, biodiesel, renewable natural gas, ethanol, electricity, and hydrogen. Our low carbon fuel practitioners provide up-to-the-minute advice on regulatory, project development, project finance, tax, and litigation matters.

Renewable Energy
