Kevin Cubeddu is an associate in the Paris office of Latham & Watkins and a member of the International Arbitration Practice.

He advises clients in complex and high-stakes international arbitrations under the ICSID and ICC Rules, with a particular focus on investment and commercial disputes involving Latin America. Kevin also advises clients on the drafting of arbitration clauses. He has acted as tribunal secretary under the ICC Rules.

Kevin’s experience includes representation of:

International Commercial and Investment Arbitration

  • The Republic of Colombia in an ICSID arbitration initiated by South32 Investments, a UK-based mining company, in relation to the calculation of royalties owed by a ferronickel mine
  • The Republic of Colombia in an ICSID arbitration initiated by Aris Mining Corp. under the Free Trade Agreement (FTA) between Canada and Colombia, in relation to the presence of illegal mining within the mines owned by the claimant and the alleged failure of the Colombian authorities to combat it
  • A Canadian investment fund in an ICC arbitration seated in Bogota related to a purchase agreement of shares in public utility company in Colombia
  • Three Mexican companies in an ICC arbitration against the EPC contractor and asset manager of their renewable energy facilities
  • A Uruguayan company specialized in the commercialization of military equipment in an ICC arbitration in Paris, under French law, against six entities of the main supplier of aviation and military equipment including its holding company

Experience as Tribunal Secretary

  • Tribunal secretary in an ICC arbitration related to a dispute between co-investors in a desalination plant in North Africa
