Janine Flohr is an associate in the Düsseldorf office of Latham & Watkins and a member of the firm’s Global Antitrust & Competition Practice. She focuses on EU and German competition law.

Janine represents international companies before the European Commission and the German Federal Cartel Office in a wide range of competition law matters, in particular with regards to antitrust investigations, litigation, regulatory aspects, and State aid matters. She has advised clients in a number of complex and high-profile merger control proceedings and has experience across various different sectors, including digital markets and technology.

Prior to joining Latham as an associate, Janine worked at the Chair of Private International, Procedural and Civil Law at the University of Münster. In that role, she specialized in research pertaining to international procedural law, contributed to publications in this sector, and organized the annual competition law meeting in Münster.

Janine also worked as a legal trainee in the Litigation & Trial Department in Latham’s Munich office and in the Antitrust & Competition Practice in the Düsseldorf office.

Janine currently serves as local leader of Latham’s Women Lawyers affinity group in Düsseldorf.

Janine’s experience includes advising:

  • Lufthansa in its defense before the Higher Regional Court of Düsseldorf and several interim appeal proceedings before the Federal Court of Justice (Bundesgerichtshof, BGH) against a prohibition order of the FCO; the team secured interim relief for Lufthansa before the Higher Regional Court Düsseldorf, whose decision was upheld by the BGH; and in concurrent investigations before the European Commission
  • Meta in the abuse of dominance probe by the FCO and subsequent proceedings before the Higher Regional Court of Düsseldorf, the Federal Court of Justice and before the European Court of Justice; as well as in other German and European antitrust matters and investigations
  • Vodafone (formerly: Unitymedia) in damages proceedings against Deutsche Telekom relating to abusive practices in the use of cable ducts
  • A global technology company in an investigation by the FCO regarding the client’s paramount significance for competition across markets decision of the German FCO
  • A manufacturer of bags and luggage in an investigation by the German Federal Cartel Office concerning resale price maintenance, leading to the closing of the investigation with a significant reduction in fine
  • Skydance Media in its merger with Paramount to form “New Paramount”, a next-generation media and technology company, in particular on media regulation aspects before the German media regulation authority
  • An international bank in a complex acquisition of shares focusing on German, Austrian and Swiss merger control and media regulation laws
