Latham Secures Victory for Orange in Case With Cambio

Latham & Watkins has secured a significant victory for client Orange, in a decision rendered on 28 September 2022 by the Commercial Chamber of the French Court of Cassation in Paris, which rejected the appeal brought by Cambio regarding alleged anticompetitive practices of Orange during the liberalization of the internet market between 2001 and 2005. The €30 million claim for civil damages brought by Cambio was entirely dismissed.

In a ruling from November 2018, the Paris court of Appeals had upheld the decision by the Paris Commercial Court from 2015, confirming that Cambio had failed to prove that Orange (previously France Télécom) had abused a dominant position in the French telecoms market or caused Cambio any damage.
