Ken Fok is an associate in the Hong Kong office of Latham & Watkins and a member of the Litigation & Trial Department.

Ken represents leading financial institutions, multinational corporations, state-owned enterprises, and high-net-worth shareholders in complex litigation and arbitration matters.

His practice covers cross-border civil and commercial litigation and arbitration, with a particular focus on shareholder, commercial and banking disputes, as well as restructuring and insolvency-related matters.

Ken’s experience includes advising:

  • Sonangol EP, the state-owned oil company of the Republic of Angola, in a long-running and complex shareholder dispute, including debt recovery, derivative action, unfair prejudice petition proceedings, and various injunction applications, concerning its stake in a business worth over US$2 billion
  • A leading Swiss private bank in an alleged breach of trust and contract claim brought by former clients in the High Court of Hong Kong*
  • A Hong Kong-listed gas company against claims brought by its former director and purported consultant, involving issues on the validity of share options worth over HK$2 billion*
  • A UK-based data center developer and operator in Europe and Asia-Pacific in relation to US$100 million debt claims across multiple jurisdictions with respect to the construction of certain data centers in Hong Kong*
  • The liquidators of a Hong Kong cryptocurrency exchange (in liquidation) involving complex issues around the nature of virtual assets and various recovery challenges. In this case, the Hong Kong Court confirmed for the first time that cryptocurrency is property under Hong Kong law, capable of forming the subject matter of trust*
  • The liquidators of one of China’s largest and most indebted Hong Kong-listed property developers in relation to the winding up of certain operating subsidiaries*
  • A major US bank in relation to an extensive investigation across 12 jurisdictions in Asia, the US, and the UK into misconduct by its traders in its client facilitation trading business*
  • Assisting in the workplace investigation for a major Australian mining company into allegations of misconduct and financial fraud by a senior executive*
