Mr. Winik is of counsel in the Washington, D.C. office, and retired from partnership on December 31, 2016. He has previously served as the Global Co-chair of the firm's Product Liability, Mass Torts & Consumer Class Actions Practice, the Deputy Managing Partner, and Litigation & Trial Department Chair. He has a broad complex business litigation background and has a concentrated practice in the areas of product safety and liability, consumer class actions and related investigations, and counseling in the consumer fraud/deceptive practices arena. The actions Mr. Winik handles often involve multiple jurisdictions, including parallel state and federal actions and actions consolidated by the Judicial Panel on Multidistrict Litigation.
The Legal 500 US guide consistently ranks Latham’s Product Liability, Mass Torts and Consumer Class Actions Practice among the nation’s best, and Mr. Winik was specifically commended by the publication in 2011 as “intelligent, strategic and communicates exceptionally well.”
Mr. Winik has represented numerous clients in investigations and enforcement proceedings involving the Consumer Product Safety Commission and other federal safety agencies, as well as before regulators around the globe. He has substantial experience in counseling clients on product recalls in the US and internationally, product labeling and other product safety issues. He also has handled many matters before the Federal Trade Commission, Consumer Financial Protection Bureau, and before various state Attorneys General concerning alleged fraudulent and deceptive marketing practices. Mr. Winik has tried cases in state and federal courts around the country, before arbitration panels and administrative agencies, and also handled appeals in numerous federal circuit and state appellate courts.
Mr. Winik is currently serving as a Board Member for the International Consumer Product Health and Safety Organization.
