Adam Herrera is an associate in the San Diego office of Latham & Watkins.

Adam advises companies in high stakes intellectual property matters, including:

  • Trademark enforcement, prosecution, counseling, and litigation
  • False advertising and unfair competition litigation
  • Copyright counseling and litigation
  • Trade secret litigation
  • Internet law, including domain name portfolio management and recovery of domain names
  • Breach of contract and commercial disputes

Adam has experience in nearly every stage of litigation, having represented clients in numerous federal and state court actions. He also regularly handles disputes before key agencies, including the United States Patent and Trademark Office’s Trademark Trial and Appeal Board and the World Intellectual Property Organization.

He also maintains an active pro bono practice, including civil rights litigation.

Adam graduated from UCLA School of Law, where he was elected to the Order of the Coif. While attending law school, he was a senior editor for the UCLA Law Review and a managing editor for the UCLA Journal of International law and Foreign Affairs. He also placed second in the UCLA School of Law Dean’s Brief Writing Competition.

Prior to joining Latham, Adam served as a law clerk for the US Attorney’s Office for the Southern District of California.

  • Universal Alloy Corporation in a trade secret misappropriation defense regarding aluminum alloy components for the aerospace industry with US$264 million in damages sought, resulting in a complete zero-liability jury trial win
  • Apple in a case involving the unauthorized use of iOS
  • Shopify in a copyright and trademark infringement lawsuit and Digital Millennium Copyright Act defense case brought by educational publishers
  • A leading exercise equipment and media company in trademark, false advertising, and unfair competition disputes
  • A marketplace for authentic sneakers and apparel in a trademark infringement and breach of contract suit
  • Codexis, Inc., a public biotech company, in a trademark dispute against another public biotech company
  • Entrepreneur Media in several trademark infringement lawsuits and trademark oppositions, as well as global trademark portfolio management
  • Evernote in a trademark infringement lawsuit
