Molly Barron defends corporate clients in complex civil antitrust litigation in state and federal courts around the country.

Molly draws on extensive experience spanning multiple industries to help clients navigate complex antitrust litigation matters — including multidistrict litigation, class action, and strategic business-to-business litigation involving claims of:

  • Monopolization and attempted monopolization
  • Monopsonization
  • Price-fixing
  • Conspiracy
  • Refusal to deal
  • Fraud
  • State unfair competition laws

She has achieved significant victories for clients at every stage of litigation, including through dispositive motions practice, at trial, and through settlement.

Molly also maintains a pro bono practice, representing clients in federal civil rights litigation and immigration matters.

Before joining Latham, Molly served as a law clerk for the Honorable J. Frederick Motz of the US District Court for the District of Maryland.

Molly’s litigation experience includes representing:

  • American National Red Cross (Red Cross) in antitrust litigation alleging the Red Cross unlawfully ties the sale of blood platelets to platelet bacteria mitigation services; secured dismissal of all antitrust claims by successfully arguing that the Red Cross’ status as a federally chartered instrumentality makes it not subject to antitrust liability because the definition of “person” under the Sherman Act does not include federal instrumentalities
  • U.S. Sugar, an agricultural products company, in defeating the DOJ’s challenge to U.S. Sugar’s acquisition of Imperial Sugar in the US District Court of Delaware – United States v. U.S. Sugar Corp. (D. Del.)
  • Dairy Farmers of America (DFA) in an antitrust opt-out case proceeding in the US District Court for the District of Vermont, in which the plaintiffs alleged that DFA engaged in monopolization and monopsonization in the milk processor market; secured dismissal of the monopoly claims and the plaintiffs agreed to dismiss the alleged price-fixing claims on the eve of trial
