Margaret (Molly) Babad is an associate in the New York office of Latham & Watkins and is a member of the Litigation & Trial Department.

Molly represents public and private companies in matters across the full spectrum of disputes, including:

  • Securities class actions
  • M&A litigation
  • Complex commercial litigation
  • Internal investigations
  • Government investigations

Molly maintains an active pro bono practice, focusing on criminal appeals and incarcerated individuals.

Prior to joining Latham, Molly clerked for Justice John Couriel of the Florida Supreme Court. While in law school, she served as a research assistant in Harvard’s Environmental & Energy Law Program, researching corporate governance and environmental standards.

Before attending law school, Molly worked as a commercial boat captain and taught marine science.

Molly’s experience includes representing:

  • A multinational software company in counseling related to shareholder demand, subsequently winning full dismissal with prejudice of securities class action related to an announced acquisition
  • Oatly in winning motion to dismiss securities class action related to its IPO, after which the case favorably settled
  • Telefónica S.A. in a dispute brought against Millicom International Cellular S.A. after Millicom improperly refused to close a deal worth over US$500 million, winning summary judgment on liability, which was subsequently affirmed on appeal
  • Toptal in a trial victory in a complex commercial litigation against a lender, defeating the defendant’s counterclaims at summary judgment and trial and winning compensatory and punitive damages
  • Vroom, Inc. in consumer class actions in Oklahoma and New York state courts, successfully compelling plaintiffs’ claims in both jurisdictions to arbitration
  • Robertshaw US Holding Corp. in a successful defense of its pre-filing liability management transactions, obtaining court approval for its Section 363 sale
