Marc Makary represents companies, government institutions, sovereign and private equity funds, and lenders in international project development and financing transactions and strategic joint ventures, primarily in the infrastructure, communications, power and water, and oil and gas industries. Mr. Makary has executed transactions in the Middle East, Europe, and the Americas, in addition to multiple developing markets around the globe. 

Mr. Makary also specializes in network infrastructure projects. He is recognized as one of the world’s leading practitioners in the subsea fiber optic cable industry, having advised tech giants and developers on the development and operation of subsea cable systems from the Americas, to Europe, the Middle East, and Asia.

Mr. Makary’s experience includes advising:

  • Air Products, as majority shareholder of a consortium, on the proposed acquisition from Saudi Aramco and operation by the consortium for the benefit of Saudi Aramco of US$12 billion in gasification assets located in Jazan Economic City
  • The owner in connection with a concession agreement, construction contract and operation, and maintenance contract for a seawater reverse osmosis plant in the Aramco-Dow Chemical Petrochemicals Complex in Jubail, Kingdom of Saudi Arabia
  • The European Bank for Reconstruction and Development, the OPEC Fund for International Development, the African Development Bank, and Arab Bank on the financing package, also involving financing from the Green Climate Fund (GCF), for the construction of ACWA Power’s Kom Ombo Solar Power Plant, the largest private solar plant in Egypt. This transaction was named African Energy Transition Deal of the Year by IJGlobal Awards 2023
  • The lead developers in connection with the joint build, supply, landing, capacity, colocation, and backhaul arrangements for subsea cable systems landing in various locations in Asia, the Middle East, Europe, and Africa 
  • The lead developer, on the proposed joint build, development, manufacturing, installation, and operation and maintenance of a submarine fiber optic cable system from Chile to Colombia, with landings in Peru, Ecuador, and Panama
  • A major oil and gas national oil company in connection with its bid for the acquisition of a participation interest in a UAE based sour gas project, involving a potential joint venture with the incumbent foreign investor 
  • The sponsors in connection with an estimated US$1.7 billion project financing of the Az-Zour North IWPP (approximately 1500 MW capacity) in the State of Kuwait
  • The Carlyle Group in connection with its US$490 million acquisition financing of the Rhode Island State Energy Center (RISEC), a 583 MW natural-gas fired power plant located in Johnston, Rhode Island, from subsidiaries of Entergy Corp, involving US$375 million secured loan facilities
  • The sponsors in connection with the US$600 million and US$435 million financings of the development, construction, operation, and maintenance of a 450 kilometers and a 378 kilometers natural gas pipelines in Mexico
  • The sponsor and purchaser on the concession agreement, services agreements, and terminal lease agreements in connection with the acquisition of an oil refinery and port terminal in the US Virgin Islands
