Greg Van Houten represents corporate policyholders in high-stakes, insurance-related matters.

Greg draws on extensive experience to advise clients on the full life cycle of insurance-related matters, including:

  • Insurance claim disputes, including high-stakes insurance recovery litigation and arbitration
  • Insurance aspects of mergers and acquisitions, including insurance-funded liability divestitures
  • Bankruptcies and restructurings that involve the transfer, settlement, or cash-out of insurance assets
  • Insurance policy renewals and placements, including the negotiation of bespoke policy wording

Greg has guided clients on matters involving virtually every insurance product available in the market, including D&O, E&O, CGL, cyber, property, business interruption, builders’ risk, pollution, and Bermuda form policies.

His insurance recovery litigation practice has involved appearing in state and federal courts across the country, and includes matters involving asbestos, medical negligence, catastrophic fires and explosions, product defect, cyber breaches, and intellectual property rights.

Insurance Recovery Litigation

  • Facilitating several multi-party settlements of catastrophic wrongful death and bodily injury matters by securing full insurance funding for the same
  • Securing full insurance funding for settlement of securities class action, notwithstanding insurer’s invocation of the “bump-up exclusion”
  • Recovering full policy limit and attorneys’ fees for a publicly traded oil and gas company, after depositions and successful motions practice in Oklahoma state court
  • Recovering full primary and excess-level policy limits and attorneys’ fees for a multinational medical laboratory after depositions and summary judgment victory in Texas federal court
  • Settling bet-the-company litigation, with 100% insurance funding, after prevailing at summary judgment on the insurer’s duty to defend in Washington federal court
  • Writing a successful appellate brief in Certain Underwriters v. BioEnergy, where a New York appellate court held the insured could recover excess of policy limits because of the insurer’s breach of contract

  • Achieving several meaningful policy wording changes in D&O and E&O/Media/Cyber policy towers for a publicly traded media tech company during the 2024 renewal cycle

Insurance-Related M&A Transactions

  • Representing a publicly traded industrial manufacturing company in the successful divestiture of its legacy asbestos liabilities, which hinged on a US$143.5 million insurance recovery
  • Representing Municipal Emergency Services, a supplier of safety equipment to first responders, as insurance counsel in connection with its divestiture of PFAS-related liabilities

Oil and Gas Litigation

  • Recovering fishing costs, expenses, and lost profits after depositions and successful motions practice in Oklahoma federal court
