    Emma Tran* is an associate in the London office of Latham & Watkins and a member of the Emerging Companies Fintech Practice and the Fintech Industry Group.

    Ms. Tran advises incumbent and emerging businesses on complex regulatory issues relating to the digitization of new and existing products, services, and platforms, both on a domestic and cross-border basis. 

    She collaborates with her client’s leadership team to deliver on projects relating to:

    • Digital investment platforms, including MiFID II, client money, and custody issues
    • Cryptoassets and the tokenization of traditional assets
    • Payment services, including PSD2/3, open banking, and PaaS / BaaS issues
    • Regulatory engagement, including licensing, advertising, and Section 166 matters

    Ms Tran’s experience includes advising: 

    Digital Investment Platforms

    • A leading investment platform on the tokenization of shares and designing their platform to enable fractional trading of shares** 
    • Goldman Sachs on building its first UK retail investment platform, Marcus Invest**
    • An emerging automated platform for sponsor SPV and fund formation**
    • An emerging automated platform for private fundraising
    • Various investment platforms and investment banks on their Brexit planning** 
    • Various investment banks on their MiFID II implementation**

    Cryptoassets and Digital Assets

    • A Tier 1 bank on tokenizing a bond issuance**
    • An emerging cryptoasset provider on their custody arrangements**
    • Various cryptoasset providers on their FCA MLR registrations**
    • A leading crypto-derivative exchange on their membership terms, rulebook, and VASP registration**

    Payment Services

    • A central bank on their payment system manual
    • A fintech unicorn on their PaaS offering and consumer duty obligations**
    • Various payments and e-money firms on their distribution and agency arrangements**

    In 2018, Ms Tran was seconded to Goldman Sachs and provided end-to-end advice for the launch of their UK digital and consumer business, Marcus.**
