Partner Phil Perry Named Litigation Trailblazer

The National Law Journal (NLJ) has recognized Washington, D.C. partner Phil Perry in its Litigation Trailblazers report, which highlights lawyers who have “achieved remarkable successes” in their field of work, according to the NLJ.

Perry, whose focus is on constitutional issues and the power of regulatory agencies, was lauded for his work in a number of subject matter areas, including the regulation of biotechnology, chemicals, pharmaceuticals and a range of other topics.  Perry’s work cited includes:

• Representing Monsanto and other clients on biotechnology and environmental issues and in a range of other litigation matters, including most recently in a successful First Amendment challenge to California’s Proposition 65 warnings – the only successful First Amendment challenge of its kind in the 32 year history of that law. 
• Representing clients in multiple cases against FDA, including cases related to drug exclusivity, pharmacy compounding and the regulation of tobacco.  
• Representing the State of Florida in an “original action” brought against the State of Georgia. The case included a five-week trial before a Special Master, which Perry led on behalf of Florida.  One of fewer than 200 original actions in US history, the dispute is among the first to seek relief for principally environmental rather than monetary harm. And, the Supreme Court ruled in Florida’s favor at the end of its most recent term.
