Product Recalls

Latham & Watkins has one of the world's leading global product safety and product recall practices.

The firm’s product safety and recall lawyers, resident in offices in Washington, D.C., Europe and Asia, have a wealth of experience assisting clients in designing and implementing product recalls on a worldwide basis, and in representing clients before the US Consumer Product Safety Commission, NHTSA, FDA, as well regulatory authorities in the European Union and Asia.

Comprehensive Expertise

Latham’s clients range from multinationals to emerging growth companies, and include many of the world's leading product manufacturers, importers, distributors and retailers. The firm counsels clients on a wide range of issues, including:

  • Handling product safety crises and other compliance issues
  • Government investigations of products
  • Product development and compliance with labeling and safety standards
  • Product recalls

Latham’s product safety team is aware of the regulatory and safety/defect reporting requirements in the United States, European Union and Asia, and the firm’s lawyers seamlessly manage product recalls and related regulatory and litigation matters on a global basis.

In a recent case that demonstrates the firm’s global capacity and expertise, a US-based client hired Latham to represent it in connection with a product investigation initiated by regulators in a European country. Ultimately, the firm assisted the client in analyzing the safety of the product and regulatory requirements in the markets around the world in which it had been sold. Latham assembled a team of lawyers in Asia, the United States and Europe, and in a coordinated fashion interacted with regulators in many different countries and developed a worldwide recall program.
