Gonzalez v. Google: Oral Argument After-Action Report

On February 21, 2023, the Supreme Court heard oral argument in Gonzalez v. Google, a potentially groundbreaking case addressing the proper interpretation of Section 230 of the Communications Act of 1934, as amended by the Communications Decency Act. Enacted in 1996, Section 230 has played an important role in enabling the development of the modern internet by shielding internet platforms from liability for content posted by third parties. The case is the first in which the Justices will consider Section 230’s scope, and comes at a time when Section 230 is the focus of criticism and debate across the political spectrum.
