The firm’s Insurance practice group was named Law360’s 2012 “Insurance Practice Group of the Year” for handling a series of recent complex insurance litigation and arbitration cases. Law360 noted that, “Lawyers with Latham & Watkins LLP's insurance group scored big in 2012, recovering hundreds of millions for clients and advancing novel legal arguments that could eliminate a long-standing defense used in California by insurers to avoid payouts.” Law360 cited the firm’s work for clients such as Rockwell Automation Inc., which was faced with numerous asbestos exposure suits seeking damages of more than $100 million; Fluor Corporation, which is seeking coverage for $75 million in asbestos claims and challenging the California Supreme Court’s 2003 decision a case (Henkel Corp. v. Hartford Accident & Indemnity) that addresses the insurance policy anti-assignment clauses for long-tail asbestos, environmental or product liability claims.
In the article, the firm’s global co-chair of the Insurance Coverage Litigation practice, Los Angeles partner Andrew Lundberg, said, “Successfully taking on insurers is like a chess game won in the fewest moves possible. Finding the insurer's Achilles' heel is a bit like attacking the Death Star, which moves ponderously but with great mass.” In addition, Los Angeles partner Peter Rosen also stated that clients are “not interested in litigating a coverage dispute. We are the frontline responder to get insurance companies to start the cash flow."
