The prosecution of parallel claims has become an increasingly common feature of investment arbitration. It can present unique challenges and produce paradoxical results. The existence of umbrella clauses or multi-layer shareholder structures adds further complexity. Our panel will discuss various discrete aspects of parallel claims and will canvass recent developments designed to mitigate the risk of inconsistent decisions. The panelists will provide a number of strategic insights based on their extensive experience in investment arbitration.
