Kathleen Y. Kim is a Litigation & Trial associate and a member of the Global Antitrust & Competition Practice in the Washington, D.C. office of Latham & Watkins.

Ms. Kim counsels clients in complex antitrust and competition matters, with a focus on litigating matters at the intersection of antitrust and technology.

She represents clients within and across a variety of industries, including technology, consumer and retail goods, life sciences, banking, pharmaceuticals, and financial services.

Ms. Kim joined Latham in 2022 after working in the Washington, D.C. office of another international law firm. She is an active member of the ABA’s Antitrust and International Sections and Young Lawyers’ Division. She serves on the Trial Committee of its Antitrust Section.

Ms. Kim maintains an active pro bono practice, and has advocated for clients in healthcare, immigration, asylum, and family law matters, often collaborating with nonprofit organizations.

Ms. Kim’s experience includes representing:

  • A large agricultural cooperative against price-fixing, monopsonization, and attempted monopsonization claims brought under Sections 1 and 2 of the Sherman Act, obtaining a stay of discovery in a federal district court
  • A global electronics components manufacturer in antitrust actions brought under Sherman Act and state law, including class actions consolidated in a multidistrict litigation, opt-out actions, proceedings brought by state Attorneys General, as well as in appellate proceedings*
  • A technology company against claims of conspiracy to monopolize an alleged essential facility, group boycott, market allocation, other claims brought under Sections 1 and 2 of the Sherman Act, and related state law claims*
  • A multinational pharmaceutical company in trial victory in Hatch-Waxman suit, affirmed by the Federal Circuit*
  • A multinational pharmaceutical company in patent infringement action, winning on summary judgment*
  • A global investment manager against competitor defamation, tortious interference, and group boycott claims during pre-trial proceedings and trial*
  • A large national bank against claims for breach of contract, wrongful foreclosure, fraud, violations of state consumer protection laws, and related claims, in individual and class actions in state and federal courts*
