The results of the midterm elections will determine the composition of the new Congress in 2023. Regardless of which political party achieves a majority in the House and Senate, the private sector can expect increased congressional oversight and scrutiny. To respond effectively to a congressional investigation, companies must navigate a unique set of considerations, issues, and risks that differ significantly from government enforcement or regulatory investigations.
In this installment of the We’ve Got Washington Covered webcast series, White Collar Defense & Investigations partners Jonathan Su, Erin Brown Jones, and Nicholas McQuaid preview the likely oversight priorities of the new Congress and outline best practices in responding to congressional investigations.
Mr. Su and Mr. McQuaid both recently re-joined Latham following federal government service. Mr. Su served as Deputy Counsel to President Biden in the White House Counsel’s Office; he previously served as Special Counsel to President Obama, advising on congressional oversight and controversy matters. Mr. McQuaid served as Principal Deputy Assistant Attorney General for the US Department of Justice’s Criminal Division, and previously served as Deputy Counsel to President Obama in the White House Counsel’s Office from 2015-2017, advising on congressional oversight and controversy matters. Ms. Brown Jones regularly counsels clients facing inquiries from Congress, as well as high-stakes criminal and regulatory investigations and enforcement actions.
