Intellectual property can often be a troublesome issue in bankruptcy as the goals of the bankruptcy law and IP are often at odds.
Finance partner, Kim Posin will discuss key issues, including the current split among federal appellate courts regarding the test applied to determine whether a debtor-licensee may assume an IP license and when a debtor-licensee may assign its IP license to an unaffiliated third party. She will also address the ways in which patents, copyrights and trademarks are treated differently in bankruptcy.
