Experience

Perry J. Viscounty is a partner of Latham & Watkins and chair of the firm's global Intellectual Property Litigation Group. He is the former chair of the Litigation Department in Orange County and the former chair of the firm's global Marketing Strategy Committee.

In his practice, Mr. Viscounty handles intellectual property, class actions and other complex litigation. He has handled a variety of matters throughout the world including trademark, copyright, patent, trade secret, domain name, right of publicity, unfair competition, false advertising and defamation cases. In addition, he advises clients on intellectual property, licensing and Internet related issues as well as domestic and international trademark prosecution.

In 2007, Mr. Viscounty lead the firm's trial team in a five-week jury trial successfully defending our client, Buzz Off Insect Shield, LLC, against claims made alleging trademark infringement, false advertising and unfair trade practices claims (S.C. Johnson & Son, Inc. v. Buzz Off Insect Shield, LLC et.al.). He also achieved a favorable settlement for our client Adobe Systems Incorporated in the Central District of California where they were sued for copyright infringement, trademark and trade dress infringement, dilution, false designation of origin and unfair competition. He also represented Allergan, Inc., in a trademark infringement, unfair competition and false advertising case regarding Botox in federal court in Utah and several countries in Europe.

Additional representative clients include Paula Abdul, Allianz, Arbonne International, Cartier SA, City of Hope, Cooper, DJ Orthopedics, Ecko, Filenet, Paul Frank,  Frank Gehry, Gap, Guthy-Renker, Intel, Mikasa, Mont Blanc, Mossimo, Nestlé, Nissan, Oakley, Office Depot, Old Navy, PIMCO, Remedy, Fred Segal, Sepracor, Sony, Spectrum Pharmaceuticals, St. John Knits, The Carlyle Group, TiVo, US Soccer Federation, Veritas, Volcom and Wet Seal.

Mr. Viscounty is a former member of the Meetings Committee for the International Trademark Association and a former chair of the Trade Secret Committee of the Orange County Patent Law Association. Mr. Viscounty is also a former member of the Board of Directors of the Federal Bar Association, Orange County Chapter, and the Whittier Law School Intellectual Property Advisory Board. 

Mr. Viscounty is an arbitrator for the World Intellectual Property Organization and has written numerous opinions on domain name cases. He has also represented several domain name registries and registrars in formation, ICANN issues and litigation.

Mr. Viscounty was recognized as a leading intellectual property attorney in the 2006, 2008, 2009 and 2010 Chambers US legal guides.  In 2009, Chambers cited him as “envied by peers as an exceptional trademark lawyer with a huge practice.”  In 2010, Chambers US recognized him in the highest tier ranking for Trademark, Copyright & Trade Secrets litigation.  He was also recognized in the 2007-2010 US Legal 500 guide for patent, trademark, copyright and trade secrets litigation and in 2009 was viewed by his clients as “offering the best legal advice.”  He has been cited in the Euromoney Institutional Investor Benchmark: Litigation guide for 2008-2010.  In 2008, one CEO referred to the courtroom performance of a team led by partner Perry Viscounty in a five-week jury trial as “spectacular,” commenting that he has “taken a complex situation and [has] been extremely aggressive, hard working, diligent and completely dedicated to the task, and [has] given us valuable perspective and advice.” 

Mr. Viscounty was also cited as a leading attorney in the 2007 US Legal 500 Litigation guide and named to the 2007 BTI Client Service All Star Team. He was named among the top IP Litigation Attorneys in California by Chambers US in 2006 and 2010, and one of the Top 30 Intellectual Property Lawyers in California by the Los Angeles Daily Journal in 2005.

At various intellectual property seminars, Mr. Viscounty has spoken on topics including trademarks, digital defamation and fraud, e-mails, trademark licensing and preventing digital disasters. He has also written extensively on intellectual property and technology issues, with articles published in, among others, The National Law Journal, IP Law 360, E-Commerce Law, AdWeek, Orange County Business Journal, Los Angeles Daily Journal and The Journal of Internet Law
